This agreement (the "Agreement") sets forth the terms and conditions governing the provision of tour guide services (the "Services") by Shinji Satake (Shinji) to the customer.
1. Services
Shinji shall provide guided tour services in Tokyo, Japan, as agreed upon by the Customer and Shinji. The specific details of the services, including duration, itinerary, and cost, shall be determined by mutual agreement.
Shinji will provide this service in good faith and strive to ensure the safety of the customer.
Shinji shall not be liable for any loss or damage caused by events beyond its reasonable control, such as natural disasters, acts of God, or force majeure.
The Customer assumes all risks and dangers incidental to the Services.
3. Payment
Prices
All prices, unless specified otherwise, are in Japanese Yen. Prices may be changed at any time for any reason without prior notice. All prices include Japan’s 10% consumption tax.
Payment Methods
You will make payment of bookings by credit card. Shinji does not store credit card information. We use a third-party service such as PayPal and/or Stripe, etc. to process your payment information for all transactions. You authorize the guide, and its payment service partners to process your payments. These payment processing services are governed by the terms and conditions of those third-party services and will apply to the payments you make through their system.
Prices are displayed in Japanese Yen. Your bank or credit card company may apply its own exchange rates, commissions, and charges when the default currency is your local currency. The exchange rates fluctuate between the time You pay and the time You take your Tour.
Invoice
After you have agreed to the guide's proposal and book your tour, and a tour guide is assigned, Shinji will email you a link to an invoice for the 50% deposit. Reception of this invoice constitutes your final opportunity to verify the accuracy of the information. Please contact the guide immediately if you note any discrepancies, errors and/or omissions related to your booking.
4. Booking process
You fill in the contact form on Tourguides.tokyo website and send the form to Shinji Satake. If you have any special requests and/or assistance from me in the tour, please write them down in the field at the bottom of the booking form.
Shinji will make a tour plan for you and send the proposal including schedule, price, and payment conditions etc. to you for your confirmation. You can request me to revise or alter the proposal until both parties agree to it.
After the agreement, Shinji emails you a link to an invoice for the 50% deposit.
You are requested to pay for the invoice online to make sure the booking. You are generally requested to complete the payment within a week from the date you receive the link of the invoice. The Tour Agreement comes into effect upon completion of the payment for the deposit.
When the payment for the 50% deposit is successful, Shinji will email you a notification.
The remaining 50% fees shall be invoiced to you a week before the tour day. This payment should be completed before the 1st day of the tour, otherwise the Tour Agreement becomes invalid, and the tour guide reserved for you is released.
Cancellations
You agree with the terms of the Cancellation Policy and understand that any cancellation by You or by us, and any related refund, will be processed in accordance with the Cancellation Policy in force at the time of your booking.
Alterations
As Product is a private tour, we can change the plan any time even after the Tour Agreement is complete as long as it is agreed by both parties. Any extra charge caused by the alteration should be borne by the party who first requests it.
6. Confidentiality and Privacy
Shinji the guide respects your privacy. I never sell your personal information to third parties. Any information you provide is used solely to facilitate your tour booking and provide the best possible service. I take steps to protect your privacy in accordance with our Privacy Policy.
7. Intellectual Property
All intellectual property rights in connection with the Services, including but not limited to copyrights, trademarks, and trade secrets, shall remain the exclusive property of Shinji.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Japan.
9. Dispute Resolution
Any dispute arising out of or in connection with this Agreement shall be resolved through good faith negotiations. If the parties are unable to resolve the dispute through negotiation, the dispute shall be submitted to binding arbitration in accordance with the rules of the courts in Tokyo Japan.
